Marina and Beach Rules and Regulations
The following are rules and regulations for our marina:
1. The owner of each parcel of property shall be entitled to one slip in the marina upon payment od assessed fees and presentation of a copy of current boat registration in his/her name, and telephone number for use in case of emergency.
2. Only members in good standing will be allowed non-commercial use of the boat ramp and marina.
3. Slips cannot be exchanged by members without the approval of the marina committee.
4. Guest slips, if available, will be supplied to the member’s guests for a period up to 48 hours. Contact marina committee information.
5. Members who rent will not assign their slip to lessee; boat registration, lease copy, and proof of insurance in lessee’s name must be presented prior to securing a boat slip. Marina committee will then assign a slip to lessee.
6. Members in good standing may be placed on a wait-list for slip re-assignment upon receipt of a written request to the marine committee. When a wait-list slip becomes available, it will be offered to the members on the wait-list in the chronological order of their requests.
7. In the event any damages is done to the marina the Association property due to negligence of lessee or said guests, private owner shall be responsible for all repairs.
8. The Association will not be responsible for any damage to boats in marina.
9. Each slip will not exceed 10 feet in width; individual boat lengths will not exceed 28 feet as recorded on state boat registration.
10. No swimming in the marina.
11. Boats leaving and entering the marina must not exceed 5 MPH.
12. There will be no overnight sleeping aboard boats, or discharging of wastes.
13. All marina dues and assessments must be paid by February 15th of each year or member’s slip may be assigned to another member. If a member wishes a slip after seasons marina work is done, and no slips are available, said member shall bear full cost of creating a new slip per marina committee specifications in addition to slip fee.
14. Nothing will be attached to or placed on the horizontal or vertical surfaces on the walkway or the bulkhead. Hardware attachments shall be secure to the horizontal stringer below the walkway.
15. Season begins May 15th and ends November 15th each year. All boats must be removed from the marina by November 15th.
16. No boat slip will be reserved unless reserve owns boat as it pertains to Article VIII – Section 1.
17. Prohibit the launch of jet skis within Pine Neck Landing Association common grounds.
18. It shall be the duty of the Marina Committee to calculate the number of requests and payments for boat slips for the coming season. In the event that the requests made and payment received for boat slips exceed the present capacity for the marina, the Marina Committee through the director of the Committee, may demand forfeiture of any boat slips which has been paid for by a member, and is not utilized by such member by the 15th day of June of such year. Demand shall be made in writing and mailed to such member at their current listed resident address, return receipt requested. The demand shall inform the member of the Committee’s intention to refund their payment for their lost boat slip, and upon refund of said payment deliver such slip for use to another member, for the remainder of the calendar year. The member shall have a period of 15 days from receipt of the demand notice, or from the Marina’s Committee’s receipt of notification that the member has refused the notice to either:
a) Commence use of slip within such 15 days; or
b) Deliver written notice of good cause as to why his/her boat slip is vacant, and as to his/her intention to use same. The Marina Committee shall determine whether or not to extend such 15 day time period to allow the member to commence use of its slip and the duration of such extension if any, and shall advise the members accordingly in writing. In the event that the use of the slip is forfeited, such forfeiture shall be for one season only, and the prior holder of the slip, upon timely payment, shall have the right to use the slip for the next season.
